OPEN ONLY TO INVITED akatoo MEMBERS
RESIDING IN THE UNITED STATES OR CANADA
13 YEARS OF AGE AND OLDER
VOID WHERE PROHIBITED OR RESTRICTED BY LAW
1. ELIGIBILITY: This akatoo Community Launch Incentive is open only to legal residents of the United States (excluding residents of Puerto Rico) and Canada (excluding residents of Quebec) who are invited members of akatoo and are 13 years of age and older at the time of entry. Void where prohibited or restricted by law. Only one winner per household. Employees of akatoo, Inc. (“akatoo”), its affiliates, agencies, agents and representatives and members of the immediate families and persons living in the same household of such employees are not eligible.
2. HOW TO ENTER: This akatoo Community Launch Incentive consists of three separate one-month contests – the first begins on April 1, 2008 and ends April 23, 2008 (the “April Contest”); the second begins on April 24, 2008 and ends May 24, 2008 (the “May Contest”); and the third begins on May 25, 2008 and ends June 23, 2008 (the “June Contest”) (collectively, the “Contest”). To enter this Contest, you must have been invited to join the akatoo community and, have an active user account with akatoo, and have the hardware, software, connectivity and applications necessary to run the akatoo service.
Specifically, to enter this Contest, you must do all of the following:
· a) Receive an invitation to join the akatoo community from akatoo or an akatoo member, and join the akatoo community.(Registering at www.akatoo.com may result in a membership invitation). To join the akatoo community after receiving an invitation, you will need to provide a user name, your name, and an email address. You will also be asked to select a password. Registration with akatoo is free; there are no registration, maintenance or other fees.
b) Locate questions in the akatoo community identified as qualifying for this Contest, and submit an answer to as many of those questions as you’d like.
· c) Your answer to any qualifying question must be received by akatoo’s server by 11:59 PM Pacific on (i) April 23, 2008 for the April Contest, (ii) May 24, 2008 for the May Contest, and (iii) June 23, 2008 for the June Contest.
To qualify for the daily prize specified in Section 3(b) below, you must refer up to seven (7) of your friends and colleagues to the akatoo community. Once any of these referred invitees join the akatoo community, you may refer additional individuals, but only so long as you have no more than seven referred invitees outstanding who have not yet joined the akatoo community at any point in time. If you have referred seven people and none of them join the akatoo community, you may not refer any additional individuals unless and until any of your seven referred invitees join.
3. PRIZES:
(a) Monthly Prizes. For each month of this Contest, the top 70 point earners will receive prizes as follows; The top 20 (twenty) contest point earners (as described in Section 5 below) as of the end of such month will each receive an iPod Nano (approximate retail value: $149), the remaining 50 contest point earner of the top 70 contest point earners will each receive and iPod Shuffle (approximate retail value: $49). Points earned in one month will not count towards any subsequent month of the Contest.
(b) Daily Prizes. For each day of this Contest (each day runs from midnight Pacific Time through 11:59 pm Pacific Time), the participant who has the highest number of his or her referred invitees register for the akatoo community on that day will receive a $50 coupon to Amazon.com (approximate retail value: $50).
The total aggregate value of the prizes to be given away in this Contest is $21,150. No transfers or substitutions of prizes for cash or otherwise are permitted, except that akatoo retains the right to substitute any prize with a prize of equal or greater value. All prizes are non-refundable and non-exchangeable. Limit one prize per household. All federal, state and local taxes on each prize, if any, are the sole responsibility of the individual winner. Each winner is also solely responsible for any and all prize-related expenses not specified above. The winner should allow approximately one month for delivery of the prize from date of the winner’s acceptance of prize.
4. ODDS OF WINNING: The odds of winning a monthly prize depend on the number of participants, the number of submitted answers and ratings, and the skill and talent of the participants with respect to their submitted answers and ratings. The odds of winning a daily prize depend on the number of participants and the number of individuals referred to the akatoo community by participants.
5. JUDGING:
(a) Monthly Prizes. The judging for the monthly prizes will be conducted by akatoo’s proprietary weighted rating management system, which will process (1) the ratings submitted by other members of the akatoo community of the quality of each answer that you post, and thereby calculate an amount of points for each such answer, and (2) the quality of each rating that you post of other akatoo members’ answers, and thereby calculate an amount of points for each such submitted rating. Every member will be granted 100 points upon joining the akatoo community. The amount of points you can earn or lose thereafter will be driven by the number of answers that you post and the quality of each such answer (as rated by the other members of the akatoo community) and the number of ratings that you post and the quality of each such rating (as calculated by the akatoo system). The 70 participants with the most points earned during April (as of April 23) will receive the monthly prize for the April Contest; the 70 participants with the most points earned during May (as of May 24) will receive the monthly prize for the May Contest; and the 70 participants with the most points earned during June (as of June 23) will receive the monthly prize for the June Contest. Total points are calculated at the end of each calendar month, hence 7 days after the last submission.
(b) Daily Prizes. The daily prize will be awarded to the first participant each day who has the highest number of referred friends and colleagues that have registered with akatoo on that particular day (as defined above, each day starts at midnight Pacific Time).
akatoo reserves the right to disqualify any participant if akatoo believes the participant has cheated or engaged in fraudulent behavior with respect to participant’s involvement in this Contest.
6. NOTIFICATION: akatoo will notify monthly prize winners via email within ten business days after each month of this Contest, and will notify each daily prize winner via email within five business days after the particular day. akatoo will use the email address provided by the participant upon registering with akatoo and shall not be responsible for any changes to the email address. Each winner must contact akatoo via email, provide his or her full mailing address and accept the prize within 15 days, or an alternate winner may be selected. Return of any prize or prize notification as undeliverable will result in disqualification and an alternate winner may be selected.
7. OTHER CONDITIONS FOR WINNERS: Each winner, and such winner’s parent or guardian if the winner is under 18 years old, may be required to sign and return an Affidavit of Eligibility and Liability and Publicity Release within 15 days of attempted prize notification. Non-compliance with this time period may result in disqualification and an alternate winner may be selected.
8. CONDITIONS OF PARTICIPATION: By participating in this Contest, each participant agrees: (a) to these Official Rules, akatoo’s terms and conditions of service (www.akatoo.com/termsofuse.html), akatoo’s privacy policy (www.akatoo.com/privacypolicy.html), and the decisions of akatoo and its proprietary system, which shall be binding and final in all respects; (b) to release, discharge and hold harmless akatoo, its affiliates, agencies, agents and representatives and the officers, directors, and employees of each from any and all claims, charges, injuries, liability, losses and/or damages of any kind caused by, resulting from or arising out of his or her participation in the Contest and/or their acceptance, use, misuse, possession loss or misdirection of a prize; and (c) to the use of his or her name, photograph, likeness and/or identity for advertising, publicity and promotional purposes without compensation, unless prohibited by law. You or your parent or guardian (if applicable) must be the authorized holder of the email account that you use to submit answers to the akatoo service and otherwise participate in this Contest. Identification (as proof of age) must be made available upon request by akatoo. akatoo reserves the right to disqualify any answer that it deems, in its sole discretion, to be obscene, threatening or otherwise inappropriate. By posting an answer to the akatoo service or otherwise participating in this Contest, you hereby assign and release to akatoo any and all intellectual property and other proprietary rights you may have in and to your posted answer or other entry information, and agree to take all steps necessary to complete the assignment and release.
9. GENERAL RULES. All federal, state and local laws apply. akatoo, its affiliates, agents, representatives and the directors, officers and employees of each are not responsible and shall be not liable for: (a) any late, delayed, lost, misdirected, damaged, destroyed, stolen, misaddressed, garbled, scrambled or incomplete transmission and/or posted answers, or improperly or ambiguously entered participant identifying information; (b) any human error or electronic, hardware, software, browser, network, Internet or computer error, failure, malfunction, congestion or incompatibility or difficulties of any kind; or (c) any condition caused by events beyond the control of akatoo which may cause the Contest to be disrupted or corrupted. akatoo reserves the right, at its sole discretion, to disqualify any individual found tampering with the entry process, or participating in this Contest in violation of any applicable laws, or employer or service provider rules. CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS IN VIOLATION OF CRIMINAL AND CIVIL LAW AND SHOULD SUCH AN ATTEMPT BE MADE, akatoo RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. akatoo reserves the right in its sole discretion to cancel or suspend the Contest or any portion thereof should any cause beyond akatoo’s control disrupt, corrupt or compromise the administration, security or proper play of the Contest.
10. LIST OF WINNERS: The list of winners’ names will be posted on akatoo’s website, www.akatoo.com, on or about April 30, 2008 for the April Contest, May 31, 2008 for the May Contest, and June 30, 2008 for the June Contest. In addition, a list of all winners will be available after June 30, 2008, by sending a stamped, self-addressed envelope, marked “akatoo Community Launch Incentive Winners’ List” and received by August 31, 2008 to akatoo, Inc. at 11400 W. Olympic Blvd. #200, Los Angeles, California, 90064.
