OPEN ONLY TO INVITED akatoo MEMBERS
RESIDING IN THE UNITED STATES OR CANADA
13 YEARS OF AGE AND OLDER
VOID WHERE PROHIBITED OR RESTRICTED BY LAW
1. ELIGIBILITY: This akatoo Community Summer Incentive is open only to legal residents of the United States (excluding residents of Puerto Rico) and Canada (excluding residents of Quebec) who are invited members of akatoo and are 13 years of age or older at the time of entry. Void where prohibited or restricted by law. Only one winner per household. Employees of akatoo, Inc. (“akatoo”), its affiliates, agencies, agents and representatives and members of the immediate families and persons living in the same household of such employees are not eligible.
2. HOW TO ENTER: This akatoo Community Summer Incentive consists one three-month contest , starting July 1st 2008 and ending September 30th 2008 (the “Contest”). To enter this Contest, you must have been invited to join the akatoo community and, have an active user account with akatoo and, have the hardware, software, connectivity and applications necessary to run the akatoo service.
Specifically, to enter this Contest, you must do all of the following:
a) Receive an invitation to join the akatoo community from akatoo or an akatoo member, and join the akatoo community. (Registering at www.akatoo.com may result in a membership invitation). To join the akatoo community after receiving an invitation, you will need to provide a user name, your name, and an email address. You will also be asked to select a password. Registration with akatoo is free; there are no registration, maintenance or other fees.
b) Post unique knowledge questions.
c) Locate questions in the akatoo community identified as qualifying for this Contest, and submit an answer to as many of those questions as you'd like.
d) Rate other answers in accordance to the terms of use.
e) Your answer to any qualifying question must be received by akatoo's server by 11:59 PM GMT on September 30, 2008.
f) All participating actions must be received by midnight GMT September 30, 2008.
g) Provide quality answers
To qualify for the Who You Know prize specified in Section 3(b) below, you must refer up to 100 (100) of your friends and colleagues to the akatoo community. Once any of these referred invitees join the akatoo community, you may refer additional individuals, but only so long as you have no more than one hundred referred invitees outstanding who have not yet joined the akatoo community at any point in time. If you have referred one hundred people and none of them join the akatoo community, you may not refer any additional individuals unless and until any of your one hundred referred invitees join and accept the registration process.
3. PRIZES:
(a) What You Know Prizes. At the end of this Contest, the top 50 participants with the highest number of unique knowledge questions that attracted the highest number of positively rated answers. Winners will receive an iPhone coupon, approximate retail value of $199.
(b) Who You Know Prizes. At the end of this Contest, the top 30 people having the highest aggregate contest points of their invitees earned between July 1st and September 30th. Winners will receive an iPhone coupon, approximate retail value of $199.
(c) It's the WYKWYK (What You Know, & Who You Know) Prizes. At the end of this Contest, the top 3 people of both a) and b) will win the MacBook air on top of their iPhone, approximate retail value of $1800.
(d) It's the What You Share Prizes.. At the end of this Contest, the top 30 people having the highest contest points earned between July 4th, and September 30th. Winners will receive an iPhone coupon, approximate retail value of $199.
The total aggregate value of the prizes to be given away in this Contest is $21,890. No transfers or substitutions of prizes for cash or otherwise are permitted, except that akatoo retains the right to substitute any prize with a prize of equal or greater value. All prizes are non-refundable and non-exchangeable. Limit one prize per household. All federal, state and local taxes on each prize, if any, are the sole responsibility of the individual winner. Each winner is also solely responsible for any and all prize-related expenses not specified above including activations, and other restrictions. The winner should allow approximately one month for delivery of the prize from date of the winner's acceptance of prize.
4. ODDS OF WINNING: The odds of winning a prize depend on the number of participants, the number of submitted answers and ratings, and the skill and talent of the participants with respect to their submitted answers and ratings. The odds of winning a prize depend on the number of participants and the number of individuals referred to the akatoo community by participants.
5. JUDGING:
(a) What You Know Prizes. The judging for the What You Know prizes will be conducted by akatoo's proprietary weighted rating management system, which will process (1) the ratings submitted by other members of the akatoo community, of the quality of each answer submitted to your question, and thereby calculate an amount of points for each such answer, and (2) the quality of each rating that you post of other akatoo members' answers to your questions, and thereby calculate an amount of points for each such submitted rating. The questions you post qualify as unique knowledge questions if determined by a member of the akatoo team, and therefore a ribbon will be displayed on the right side of the question. The method used by the akatoo team to determine such conclusion is determining whether a question posted will trigger any possible response that provide general conventional or unconventional knowledge.
(b) Who You Know Prizes. The judging for the Who You Know prizes will be conducted by akatoo's proprietary weighted rating management system, which will process (1) the ratings submitted by other members of the akatoo community of the quality of each answer that your invitees post, and thereby calculate an amount of points for each such answer, and (2) the quality of each rating that your invitees post of other akatoo members' answers, and thereby calculate an amount of points for each such submitted rating. Every member will be granted 100 points upon joining the akatoo community. The amount of points your invitees can earn or lose thereafter will be driven by the number of answers that your invitees post and the quality of each such answer (as rated by the other members of the akatoo community) and the number of ratings that your invitees post and the quality of each such rating (as calculated by the akatoo system). The 30 participants with the most aggregate points earned by their invitees between July 1st 2008 and September 30th 2008 will receive the Who You Know prize. Total aggregate points are calculated on October 7th 2008, hence 7 days after the last submission on September 30th 2008.
(c) What You Share Prizes. The judging for the What You Share prizes will be conducted by akatoo’s proprietary weighted rating management system, which will process (1) the ratings submitted by other members of the akatoo community of the quality of each answer that you post, and thereby calculate an amount of points for each such answer, and (2) the quality of each rating that you post of other akatoo members’ answers, and thereby calculate an amount of points for each such submitted rating. Every member will be granted 100 points upon joining the akatoo community. The amount of points you can earn or lose thereafter will be driven by the number of answers that you post and the quality of each such answer (as rated by the other members of the akatoo community) and the number of ratings that you post and the quality of each such rating (as calculated by the akatoo system). The 30 participants with the most aggregate points earned between July 4th 2008 and September 30th 2008 will receive the What You Share prize. Total aggregate points are calculated on October 7th 2008, hence 7 days after the last submission on September 30th 2008.
akatoo reserves the right to disqualify any participant if akatoo believes the participant has cheated or engaged in fraudulent behavior with respect to participant's involvement in this Contest.
6. NOTIFICATION: akatoo will notify What You Know, Who You Know, What You Share and WYKWYK prize winners via email within ten business days after the end of this Contest. akatoo will use the email address provided by the participant upon registering with akatoo and shall not be responsible for any changes to the email address. Each winner must contact akatoo via email, provide his or her full mailing address and accept the prize within 15 days, or an alternate winner may be selected. Return of any prize or prize notification as undeliverable will result in disqualification and an alternate winner may be selected.
7. OTHER CONDITIONS FOR WINNERS: Each winner, and such winner's parent or guardian if the winner is under 18 years old, may be required to sign and return an Affidavit of Eligibility and Liability and Publicity Release within 15 days of attempted prize notification. Non-compliance with this time period may result in disqualification and an alternate winner may be selected.
8. CONDITIONS OF PARTICIPATION: By participating in this Contest, each participant agrees: (a) to these Official Rules, akatoo's terms and conditions of service (www.akatoo.com/termsofuse.html), akatoo’s privacy policy (www.akatoo.com/privacypolicy.html), and the decisions of akatoo and its proprietary system, which shall be binding and final in all respects; (b) to release, discharge and hold harmless akatoo, its affiliates, agencies, agents and representatives and the officers, directors, and employees of each from any and all claims, charges, injuries, liability, losses and/or damages of any kind caused by, resulting from or arising out of his or her participation in the Contest and/or their acceptance, use, misuse, possession loss or misdirection of a prize; and (c) to the use of his or her name, photograph, likeness and/or identity for advertising, publicity and promotional purposes without compensation, unless prohibited by law. You or your parent or guardian (if applicable) must be the authorized holder of the email account that you use to submit answers to the akatoo service and otherwise participate in this Contest. Identification (as proof of age) must be made available upon request by akatoo. akatoo reserves the right to disqualify any entry, question or answer that it deems, in its sole discretion, to be obscene, threatening or otherwise inappropriate. By posting an answer to the akatoo service or otherwise participating in this Contest, you hereby assign and release to akatoo any and all intellectual property and other proprietary rights you may have in and to your posted answer or other entry information, and agree to take all steps necessary to complete the assignment and release.
9. GENERAL RULES. All federal, state and local laws apply. akatoo, its affiliates, agents, representatives and the directors, officers and employees of each are not responsible and shall be not liable for: (a) any late, delayed, lost, misdirected, damaged, destroyed, stolen, misaddressed, garbled, scrambled or incomplete transmission and/or posted answers, or improperly or ambiguously entered participant identifying information; (b) any human error or electronic, hardware, software, browser, network, Internet or computer error, failure, malfunction, congestion or incompatibility or difficulties of any kind; or (c) any condition caused by events beyond the control of akatoo which may cause the Contest to be disrupted or corrupted. akatoo reserves the right, at its sole discretion, to disqualify any individual found tampering with the entry process, or participating in this Contest in violation of any applicable laws, or employer or service provider rules. CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS IN VIOLATION OF CRIMINAL AND CIVIL LAW AND SHOULD SUCH AN ATTEMPT BE MADE, akatoo RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. akatoo reserves the right in its sole discretion to cancel or suspend the Contest or any portion thereof should any cause beyond akatoo's control disrupt, corrupt or compromise the administration, security or proper play of the Contest.
10. LIST OF WINNERS: The list of winners' names will be posted on akatoo's website, www.akatoo.com, on or about October 7th, 2008 for the What You Know, Who you Know and What You Share contest between July 1st 2008 and September 30th 20008. In addition, a list of all winners will be available electronically after October 7, 2008 or by sending a stamped, self-addressed envelope, marked "akatoo Community Summer Incentive Winners' List" and received by November 30, 2008 to akatoo, Inc. at 11400 W. Olympic Blvd. #200, Los Angeles, California, 90064.
